Terms and Conditions for Use and Sales
These terms and conditions were last updated on 11th June 2018.
1.1 These terms & conditions set out the terms between you the customer and us the website owner.
1.2 Your use of this website and any service contained within constitutes acceptance of these terms & conditions in full.
1.3 You should not use this website if you do not accept these terms & conditions in full.
2. Customer Information
2.1 You should always check that the contact information you provide is correct before creating a customer account or proceeding to payment.
2.2 You are responsible for maintaining your own username and password, where required, to access your customer account. You should ensure that you store your username and password securely and that the details required to access your customer account are not provided to another party.
2.3 As a customer you are responsible for your customer account and actions taken within it. If you are aware or suspect that your customer account username and password or other details have become known to a third party, you should inform us immediately.
2.4 Our website is only intended for use by adults. You must be of legal purchase age in your country of access or residence in order to buy any alcoholic beverage from Stannary St Wine Co. (minimum legal drinking age in the UK is 18).
2.5 We reserve the right to restrict or remove your access to this website where you breach these terms and conditions. Such restriction or removal will take place without recourse or explanation to you where we solely deem it appropriate or necessary.
4. Product description
4.1 We sell still and sparkling wines, which contain 10% to 15% of alcohol by volume; this is usually written in the form 15% ABV (short for 15 percent Alcohol by Volume).
4.2 Our wines are sold in glass bottles of the following sizes: 37.5cl, 75cl and 150cl.
4.3 We also sell accessories such as wine glasses, wine decanters and a wine preserving system called Coravin (more information onhttp://www.coravin.co.uk/ ).
5. Product Pricing, Title and Responsibility
5.1 We make every effort to ensure that the pricing displayed on our website is correct. However, if an error in the pricing of a product is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any over-payment made by you (as applicable). The processing of an order can be cancelled or corrected by us at anytime up to the shipment of that order and any related items.
5.2All prices are quoted in bond and exclude UK duty, VAT and delivery charges. These charges will be calculated by the website and added to your order at check-out, as follows:
Duty and VAT will be invoiced at check-out for all duty-paid deliveries.
Duty and VAT will not be charged for under bond transfers.
If you store the wines in bond with us, we will charge you for Duty and VAT when you wish to have the wines delivered .
If you store the wines in bond with a bonded warehouse of your choice, they will charge you directly for Duty and VAT when you wish to have the wines delivered.
Delivery charges for either type of orders will be calculated by the website at check-out.
For orders delivered duty-paid, the VAT will be clearly and separately displayed on all email receipts as part of the total cost of your order.
5.3 UK Excise duty rates:
Rates are per bottle, Excluding VAT at 20%, from 13th March 2017:
per 75cl bottle
Wine 5% -15%abv
Exceeding 8.5% but not exceeding 15% abv
5.4 We reserve the right to alter all wine pricing without notice.
5.5 Title in any wines ordered from us does not pass to you, the purchaser until we have received and processed a valid payment, and that payment has been made into our own bank account and your order has been shipped and received by you.
5.6 We are responsible for any loss or damage to any products until you receive them.
6. Your Order
6.1 Minimum order is one full case.
6.2 When you place an order you will automatically receive a confirmation email from us to confirm your order. Your order constitutes an offer made to us to purchase the goods specified in the order.
6.3 Your offer is only accepted by us once we have emailed you to confirm the dispatch of your order.
6.4 Product items not included within the dispatch email are not included in the order and contract between you and us.
6.5 We reserve the right to delay or refuse orders where a transaction contains incomplete details or details that cannot be verified or where fraud is suspected.
6.6 If we are unable to reasonably ascertain these details or resolve these issues a full refund will be made against the card used at the time of purchase. No other form of refund or credit will be offered nor will a refund be made to any third party card or account.
7. Online payments
7.1 Stannary St Wine Co is responsible for the website transaction.
7.2 We do not store your credit card details in the system. To proceed with the payment, you will be transferred to a secure page (SSL) where you can securely enter your card details.
6.3 We accept the following payment cards: Mastercard, Maestro and Visa.
8.1 All orders received by us are shipped subject to availability.
8.2 We only deliver in the United Kingdom.
8.3 Orders will not be processed or delivered on Public Holidays. Orders received will be processed on the next working day and delivered one day later to addresses within the M25. Delivery times outside London range from 1 to 5 working days. Please enquire via email email@example.com or call 020 7582 6865.
8.4 Orders received after 1pm will be deemed to have been received the following working day.
8.5 Delivery charges are as follows:
Delivery to mainland UK is free on all orders over £100 ex-vat (£120 inc-vat).
Delivery to Northern Ireland is free on all orders over £250 ex-vat (£300 inc-vat).
Delivery to mainland UK on all orders below £100 ex-vat (£120 inc-vat) is charged as follows:
London: £15 ex-vat (£18 inc-vat)
Outside of London: £25 ex-vat (£30 inc-vat)
8.6 Acceptance:Goods will be deemed to have been received satisfactorily unless claims to the contrary are made within three days of delivery.
8.7 We reserve the right to ship products at a later date (up to 28 days after purchase) where the product ordered is not in stock at the time of purchase. In this situation you will be contacted and offered a full refund instead of delivery of the product.
8.8 We cannot be held responsible for disruption to shipping caused by industrial disputes or action outside our direct control. If such disruption occurs you will be offered a full refund.
9. Cancellation Rights, Returns and Refunds
9.1 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 – which replace the Consumer Protection (Distance Selling) Regulations 2000 you have a right to cancel your purchase. However, to exercise this right you must notify us in writing, (email or letter) within 14 working days from the day after you receive your goods.
9.2 As stated above notification of cancellation must be in writing. We will acknowledge receipt of your cancellation request and call you to arrange collection of the wines. Please note - a telephone call is not a valid cancellation.
9.3 Any refund or exchange of wines deemed to be faulty shall be granted at the discretion of Stannary St Wine co. upon the return of the goods. This does not apply for broking wines which are not refundable.
9.4 No right of cancellation, refund or return exists under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 once you have used your product, unless the product is defective and you are returning it for this reason.
9.5 Bottles that are open can only be returned if they are faulty. This does not apply for broking wines which are not refundable.
9.6 Please observe the following procedure for all returns to us:
9.7 On the back of your delivery note or on another piece of paper, (if you no longer have your delivery note), include your order number and the reason for the return.
9.8 If you are returning your wine because it is faulty, please state the defect or defects.
9.9 Repackage the bottles in their original packaging. For example, in the case of a wine being delivered in a wooden case, we will be unable to issue a refund where the wine is returned in a different box.
9.10 If the original packaging has been damaged or destroyed we will only issue a refund if the wine is being returned due to a fault. If the original packaging of a defective wine has been damaged or destroyed you should ensure that the returned wine is adequately packed for shipment back to us.
9.11 You are responsible for paying any collection costs incurred when returning a wine which is not faulty.
9.12 The cost of returns will be charged at cost, using our regular couriers: London City Bond, APC or CYC, depending on your postcode. These costs will be made clear to you over the phone or via email before the collection is booked.
9.13 We will not issue refunds for any wines lost or stolen in transit to us, unless you have clearly signed the Courier company’s Collection note.
9.14 Subject to the above, we will refund the purchase price of a returned wine within 14 days of receiving written notification of your intention to return it. Where we have not actually received the returned wine we will need your signature on the Courier’s collection prior to issuing a refund.
9.15 We will collect wines free of charge if incorrectly sent by us.
10. Broking Stock
10.1 All broking prices are In Bond (exclusive of UK duty and VAT) unless otherwise stated.
10.2 All broking wines are offered per case size and cases can not be split.
10.3 All wines are provisional and subject to our confirmation, upon acceptance of order.
10.4 Stannary Street Wine Co. act as agent for broking wines and can’t be held responsible for faulty wines. Broking wines are not refundable by Stannary St Wine Co.
10.5. Delivery of broking wines can be subject to delays and we can not guarantee next day delivery. Contact us to get a delivery estimate.
10.6 We are willing to purchase and resell your wines providing the following conditions are met.
10.6.1 The wine is held in our private reserve account at LCB Vinotheque or LCB Creek Rd in a condition suitable for resale. Should the wine come from outside of our storage facilities it must be of proven provenance, in original wooden case and in good condition.
10.6.2 If the wines are not stored in our private reserves facility they may be subject to receipt, handling and delivery charges.
10.6.3 The Sellers agreement in writing to our terms and conditions and selling prices must be received before we list the wines.
10.6.4 The Seller may at any time instruct us in writing to withdraw the wine from sale on our broking list.
10.6.5. The wines will be listed for sale on our broking stock list, website and may also be marketed in appropriate offers.
10.6.6. The Stannary Street Wine Company will regularly review any remaining unsold wines and we may contact the seller to discuss any pricing adjustments relevant to current market conditions.
11. En Primeur Stock
11.1 All wines are provisional and subject to our confirmation, upon acceptance of order.
11.2 All En Primeur wines are at the time of offer being stored in their country of origin.
11.3. For certain wines where demand is very high, there may be a small time delay in confirmation of website sales and therefore we will have to confirm your order by email in case the wine has been over-subscribed.
11.4. Occasionally it can happen that wines are sent by growers in cases of 12 not 6, despite they were ordered by us in cases of 6, obliging us to split cases where we have orders for just 6 bottles.
11.5. Delivery of en primeur wines
Most of the white wines will be shipped before the summer and most of the reds after the summer between September and Christmas. We will then endeavour to deliver or transfer the wines to you or your bond as soon as possible, please be aware that we can not confirm a precise delivery date at the time of ordering.
11.6 Cost of delivery
All en primeur wines are delivered duty paid and will incur a duty and VAT invoice, payable before the wines are dispatched. We will try and group deliveries wherever possible, so may wait to send your case of white until the red is also available to send. Delivery to one address in mainland UK is free for orders over £100, otherwise delivery will be charged at cost.
11.7 Cost of under bond transfer
Small transfers under bond to other bonded warehouses other than LCB will be charged at cost. Transfers to your customer reserves at Vinotheque will be free.
11.8 En primeur wines are offered for a limited amount of time. We reserve the right to change the expiry date of the offer.
12. Customer Complaints

13. Faulty Products
Where you experience a fault with a wine or accessory it can be returned to us subject to our returns policy above. This does not apply for broking wines which are not refundable.
14. Events Outside Our Control
We shall not be liable for delay or failure to perform any obligation under these Terms & Conditions if the delay or failure is caused by any circumstances beyond our reasonable control, including, but not limited to, acts of god, war, civil disorder or industrial dispute.
15.1 Wegrant you a licence to access the content, information and services contained within our website for personal use only.
15.2 This licence allows you to download and cache (using your browser) individual pages from our website.
15.3 This licence does not allow you to download and modify individual pages or substantial parts of our website nor to make our website available via an intranet, where our website or a substantial part of it is hosted locally on the intranet in question.
15.4 Our website design, layout, photography, content or text cannot be copied, edited or otherwise manipulated without our express prior written permission.
15.5 Our website cannot be placed within the frame-set of another site.
15.6 Third parties are not allowed to “deep link” to pages within our website, without our express prior written permission. All links (unless expressly permitted by us) should be to the main index page of our website. Furthermore, the content of such links, whether graphic or text should not be misleading, false, derogatory or in any other way offensive.
15.7 The restriction on “deep linking” does not apply to affiliate partners who wish to send customers directly to a particular page or product in order to increase their affiliate sales.
16.1 All content, databases, graphics, buttons, icons, logos, layouts and look & feel are our copyright, unless expressly acknowledged as otherwise.
16.2 The data mining, extraction or utilisation of product information from our website is not permitted without our express prior written permission.
17. User Generated Content
17.1 Where the facility exists you may provide reviews or public feedback on the website of products purchased by you, also known as user-generated content.
17.2 Where the facility exists such user-generated content can be provided in different formats and mediums; text, audio, video and still photographs.
17.3 As part of providing this content to us you agree to grant us a worldwide, irrevocable, non-exclusive and royalty-free license to use, distribute, edit, translate and repurpose such content, as we require, including sub-licensing to other parties.
17.4 Such content shall not infringe the intellectual property rights of any other party. Furthermore the content shall not be illegal or capable of breaching the laws of any jurisdiction in which it may be displayed.
17.5 We reserve the right to remove any content, which breaches or risks breaching these terms and conditions.
17.6 However, we shall not assume any responsibility for auditing or monitoring any user generated content.
17.7 Any complaints about such content by rights holders or any user or visitor to our website should be directed to us using our contact details listed at the end of these terms and conditions.
18. Limitations and Exclusions of Liability
18.1 Where content and information is provided on the website without charge we exclude all liability for such content and information.
18.2 All business losses (including, but not limited to) loss of profits, income, revenue, damage to goodwill, loss of other commercial contracts, other commercial opportunities are all excluded.
18.3 All indirect, consequential or special losses or damage are all excluded.
18.4 All other losses or damages not reasonably foreseeable at the time of the contract between you and us are also excluded.
18.5 All losses relating to the loss or corruption of data, databases, systems, software or hardware are all excluded.
18.6 These terms and conditions do not exclude or limit liability for death or personal injury caused by you or us.
18.7 These terms and conditions do not exclude or limit liability for fraud or fraudulent misrepresentation caused by you or us.
18.8 These terms and conditions do not exclude or limit liability where this conflicts with the applicable law for this jurisdiction.
By your use of our website you hereby indemnify us and undertake to keep us indemnified at all times now and in the future against all possible claims relating to any breach of these terms and conditions by you. Such indemnities to include, (but not be limited to) all costs legal and otherwise, all other expenses, damages or settlements arising from your breach of these terms and conditions.
We reserve the right to vary these terms & conditions at any time, without giving notice to you. Such varied terms and conditions shall automatically apply to the use of our website from the date of publication on our website.
We reserve the right to assign our rights and also our obligations under these terms and conditions, without giving notice to you. This right of assignment shall only apply to us and shall not apply to you in any way.
The foregoing paragraphs, sub-paragraphs and clauses of these terms & conditions shall be read and construed independently of each other. Should any part of this agreement or its paragraphs, sub-paragraphs or clauses be found invalid it shall not affect the remaining paragraphs, sub-paragraphs and clauses.
Failure by us to enforce any accrued rights under these terms & conditions is not to be taken as or deemed to be a waiver of those rights by us unless we acknowledge the waiver in writing.
24. Third Parties
These terms and conditions are between you and us. They do not apply to, or benefit any third party and are not reliant on any third party.
25. Entire Terms & Conditions
These terms & conditions set out the entire agreement and understanding between you and us.
26. Your Statutory Rights
Where acting as a consumer your statutory rights are unaffected.
These terms & conditions shall be interpreted, construed and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.
